@Seamus Byrne – I meant more photo evidence of others getting it. EB said just one wasn’t enough.
I tried GAME Chatswood – the guy had the nerve to laugh at me and say there were no copies in Australia. I then gave him the link and he said “I hope K-mart enjoys their fine.”

Apparently K-mart is not only getting fined a hefty sum for breaching the street date, but won’t be allowed to sell Gears of War 2 when that launches. Not sure if that’s just the one offending K-mart or the whole chain.

The guy I spoke to at EB Garden City said KMart have been fined and won’t be allowed to sell Gears of War 2 because of this.

Well, when I asked my boss at GAME Kingsway (Perth), he told me that he’d heard about what K-Mart Innaloo had done, and as a result, the distributer (Microsoft) would not be issuing them any copies of Gears of War 2 at launch. Bad luck for K-Mart, I guess.

Hey its Linc the guy who posted the photo’s the game is great i actually work at EB in Innaloo i was spewin when a guy came up and said K-mart was selling copies i got the 2nd last one i also rang head office and found out we still couldn’t sell it because we needed proof from 2 different retailers so i salute u gamers who also got a copy early :D
P.S: Kmart didn’t have any CE copies and by now i doubt anyone else will get the game early also Kmart got fined $1,000 a piece for each copy they sold and wont get gears 2 until 2 weeks after release date and that’s all stores! :P

I work at GAME in Chatswood and I believe you spoke to me. Actually what I said was ‘nobody should have received their copies yet’ which is true. You claimed to have pictures as proof, not a link and I informed you it did not matter as we had not received our copies yet anyway.
And yes, Kmart will be getting a fine. I find this funny.

Hi i just heard about this yesterday being posted on Kotaku i work for Kmart in Victoria, This happened at our store as well we now only have one copy left with a Managers angry scrawl on it “DON’T SELL TILL THE 22ND!!”. I laughed when i saw that sucker out back. (in the sense someone sold a few before street date)

Hi, i work at kmart also, its not kmart the business that is at fault, its the stupid workers who ignore the embargo letter that comes in the box with the games. we got ours fable 2 games with a letter saying not to sell before the 23rd. which i have not yet. kmart did not deliberately breach the release date it was the dumbass workers who cant read. we get embargo letters for cds also that cant be released before a certain date so the workers should know by now about games being embargoed also, like halo 3.

Hey guys this is a empolyee of a EB games just letting you know Fable 2 is now availible from the 21/10/08. Microsoft choose to release it earlier then the offical street date so we will be selling it and so with the other retailers. Cant wait see you tomorrow

i used to work at kmart knight and usually when its embargoed its plastered over the box, this was not the case, the distibutors have a bit to play in this matter i feel
