GameFly Pays First Class Postage For Second Class Treatment

GameFly — the enormously successful rent-video-games-by-mail service — filed an official complaint yesterday with the Postal Regulatory Commission.

The Los Angeles-based company says that the United States Postal Service is responsible for breaking between one and two percent of 590,000 video games shipped each year with their automated sorting machines. That doesn’t sound like a lot of games, but Ars Technica’s done the math – putting the cost to GameFly for broken games at $US295,000 a month.

Besides breakage, GameFly is sore about games being stolen out of the mail; though it does give the Office of Inspector General and the Postal Inspection Service credit for arresting 19 USPS employees in connection with the thefts. The company is also annoyed that working with USPS to find a solution has only cost GameFly more money as they experimented with heavier and bigger mailer to try and protect their product.

The final insult, though, is the claim that Netflix and Blockbuster have it better. According to GameFly, USPS manually plucks Netflix and Blockbuster DVD mailers from the sorting line en route to the machine to protect them from breakage. GameFly’s complaint alleges that they’ve asked for comparable treatment for their game mailers, but that postal service hasn’t done it. With Blockbuster renting out video games by mail, says the complaint, “GameFly now faces direct competition from a rival that is larger and longer established – and which, because of the preferential treatment given by the Postal Service, enjoys a substantial cost advantage in the distribution of its DVDs to consumers.”

GameFly told Kotaku today that because this is a legal matter, they have no official comment at this time. Their complaint says in the Relief Requested section that GameFly wants the Commission to immediately hold hearings on their grievances and offer them “reasonable and nondiscriminatory rates and terms of service.” Like now, before more games get broken and Blockbuster noms on the market.

    I hope they win this in court, they are a good company I have always enjoyed. I have been a Gamefly customer for 5-6 years now and have never received a broken disk that I can remember.

    However I did have two games stolen with their empty envelopes arriving in their place on my doorstep, that was 2 in a row also so it was probably the same person, maybe the mail guy. I still remember what game it was both times too, Family Guy: the game for PS2 I still have never played that game cause the 3rd time I just rented something else and it arrived NP.

    While I'm not a GameFly member (I haven't "rented" games since the 16-bit era) I have used their "store" to buy some really fantastically priced games (Force Unleashed and Mercenaries 2 for $17 each with free shipping) and I'm very satisfied with that aspect of their services. They guarantee cases and manuals which have never been "used" and they deliver on that promise.

    If I DID rent games I'd consider using them based on the positive experiences I've had with them to date and since I'm NOT a huge fan of the USPS based on the myriad of negative experiences I've had with them - I wish GameFly the best of luck in this battle.

    @McDollar: Ive never had an issue with broken games but they did cancel my service due to not getting two games I sent back to them. Two of my achievement whoreN games so there was no reason to keepem. It sucks but now I just buy used from gamestop and return them within the seven days for a full refund.

Some very smart people realized that the USPS sucks..(Although I would say UPS is about equal, at least in my area as far as service goes) just because the federal government or government name is attached to something does not guarantee quality. After all, your business is only as good as your employees..

    @_Perp: Slow service was the reason I dropped Gamefly. It was a minimum of 14 days between the time I returned one and got the next. I just couldn't justify the price for that kind of turnaround time. On the other hand, the discs were never broken or stolen.

    I want Netflix to buy out Gamefly. Problem solved.

    To hell with broken games how about paying 25.00 a month to only recieve 2 games cause it takes so long for usps to distrbute them....SF4 was shipprd to me 4-11-09 i didnt get it till 4-24-09 for those who cant add thats thirteen days. this has happened several different times to me

    @shenanigans123: Gamefly has actually saved me money from buying full priced games that I ended up not enjoying or were too short.

    Been subscribed since the PS2 era and still no broken discs. One lost game from all that time was the worst that has happened which they resolved without a fuss.

    Hope this gets resolved or else we might be seeing another slight membership fee increase =(

    @UberScytheLord: with netflix if I drop the disc in the mail monday on wednesday I have the next movie. with gamefly if I drop it monday I'll have the next one maybe friday. I think it has more to do with netflix's envelopes being scanned at the post office so they know it is being returned en route and they can go ahead and ship the next one before receiving the last one. gamefly doesn't do this and can't because of their packaging.

    @b-radicate: I've been a subscriber for over 5 years (wish they had a discount tier for that!) and I've never received a broken disc or not received my game. there were a couple times where a game didn't make it back to them but that was years ago. I LOVE gamefly. especially the discounted price to keep what can be essentially a new game. plus no stupid gamestop yellow stickers.

    As a gamefly customer I hope this gets resolved. I would hate to pay extra money on my subscription because of this. Now I know why Gamefly started shipping its games with those cardboard sleeves.

    to be honest i work for royal mail ( uk postal company) and we treat things like this very badly. the uk version of these firms like lovefilm and blockbuster have there packets of the disks on the floor or just everywhere ive seen people step on them before and not bother to pick them up

    I purchased a copy of mad world and when they shipped my case, it was split at the top...im sure this was due to poor handling by USPS. GF promptly shipped me a new case no questions asked.

    @shenanigans123: Yeah this seems like a raw deal for Gamefly because either they charge us for it or they eat the costs. It's sad that a few bad employees at the USPS stole Gamefly games..makes sense since games are worth double or triple the DVDs Netflix is sending.

    Ironically their packaging is sturdier than Netflix for shielding the disc, which is probably exactly why Netflix gets more careful treatment from USPS! =)

    Gamefly does have problems though, but they're the only major player in game rentals. If they get some real competition I expect them to step up.

    Since being a Gamefly member just shy of a year now I can say I have been extremely satisfied. I've never had an issue with receiving and returning my games. I do mail directly out of my post office and I receive the games through a P.O. Box. I wonder if that makes a difference? I hope USPS can right the wrongs done to Gamefly and if their is shenanigans going on I hope that they remedy them ASAP.

    @DragonYen: That's sad. I've had GameFly for almost two years now and have never received a broken game, even considering my games didn't ship with the cardboard protectors for a while (which have since become standard).

    I hope GameFly can resolve their issues, I love their service and don't want them to have to raise prices to deal with the issue.

    @Rey Rodrigues: I just hit my 1-Year with GameFly, and got my first broken game. Eat Lead came with a 1 inch break working outword from the center of the disc. To GameFly's credit, they took care of the issue.

    It's also machine-sorted at extremely high speed with a series of top/bottom rollers, and any flexing this process may cause would seriously increase the chances that the discs will break. Hence why, as GameFly is claiming, other rent-by-mail services have their discs pulled out of the mix and hand-sorted to prevent this from happening.

    I rented a Blu-Ray movie from Blockbuster ONCE! when I got it home it was definitely not a retail disk. It was a copy. The label looked like it was printed using Light-Scribe. The disk itself locked up after 45 minutes. I took it back to Blockbuster, and, thankfully it locked up in their PS3 also. After looking at a few of their Blu-Ray movies by taking them out of their sleeves, it was apparent that this is how Blockbuster delivers them. I will never, ever, rent a Blu-Ray movie from them again.

    A month ago, I got an email from Gamefly letting me know that they sent out Legends of WrestleMania, but it never showed up. I let them know about it, and they sent out a replacement copy of LoWM for me to enjoy.

    I just got an email today thanking me for returning my copy of LoWM, even though the disc is still currently in my 360. I hope whoever had the first copy enjoyed the game as much as I did (ya asshole!).

I forget their title, but it was handwritten by them explaining that my mail had been opened and they wished to have my assistance in hunting down the culprit. They also assured me that this was not common in the area and they were taking it with the utmost seriousness. I shrugged, mailed it off with all pertinent info. Never heard back! Hope they nailed him to the wall.

Sometimes it's just your disgruntled post man, you should file a complain about whoever it is.
    But then again, who can you trust there anyways?

    I think Gamefly needs to focus more on their inventory and stock. I used the service for almost three years but recently dropped it. It takes too long to get a new release from them anymore. I waited 6 months for Deadspace and few other noteworthy releases from last year to become available, and I was still waiting.

    On the good note, I had very few problems with my actual mail service from them.

I called them to make sure it was in stock. They said it was. I get there. It wasn't. I live about a minute away from the place and no, I didn't call the wrong number.

    @Bob Dole does in fact have wood: I was a Letter Carrier for 2 years, and I can tell you personally that I HAVE seen Gamefly envelopes damaged more often than Netflix or Blockbuster. Personally though, I took great care in making sure they were sorted and delivered safely. Some of us are gamers too. Or were.

    Just remember that the USPS is one of the biggest employers in the country. There's definitely going to be some bad seeds mixed in.

    Weird, when I first was renting through Gamefly 3 to 4 years ago they always had cardboard sleeves. About a year and a half ago they stopped using the cardboard saying that it wasn't needed.

    Gamefly started putting barcodes on the mailers so when you sent it back your next game would be shipped once the post office scanned the return. My area was so crappy they stopped scanning stuff after a few months so it would take a week plus a couple days to get the next game and the Gamefly center was a three hour trip from the central post hub in my state. My only experience with loss/theft was after one was scanned, I received the new game and then Gamefly sent me a nasty email. I had to send a response back. Least it didn't happen to me again.

    Gee the USPS is inadequate hard to believe seeing how they hire people to fill quota instead of the best people for the job. Kind of like any government body sure you get some good quality people once in a while but they are rare gems compared to the rest of the trash they hire off the street.

    Recently decided to keep RE5 (PS3) from GameFly, and the package containing the game case was punctured and the case within broken upon arrival. I don't blame GameFly though, I've been using them for about 2-3 years now, and I'm very happy with their service.

    @Kobun: Well, when you think about it, most First Class mail is flat, and thin like those envelopes, so if you've ever seen a video of them being sorted, they aren't getting smashed by the weight of big cardboard boxes... they are just sliding across regular envelopes.

    The problem comes in with careless manual handling, in my opinion. Even if the envelope gets caught in the machine, the worst that happens is you get a torn up Netflix envelope, and the DVD is still fine.

    I was doing the math in my head and I'm not good at math, but 1-2% of 590,000 games...does not add up to close to $300,000 a MONTH. So I went to the source article and Kotaku made a boo-boo.

    According to Gamefly's numbers, it mails out 590,000 games and receives 510,000 games back from subscribers a month.

    So it's per month they lose around 80,000 games, which is indeed large. Though in the USPS's defense I know of people who say the game was lost in the mail and then keep it for themselves.

    There is absolutely no sense in that crap. I'm not a GameFly costumer (But am a Netflix cust., and have only received 1-2 scratched discs in 3 years. Nothing ever broken, including Blu-ray), but I really appreciate them taking a stance on this issue.

    But Gamefly never charged me for the loss, and for that I thank them.

We tried to file a complaint at the post office about stolen mail, and they told us they couldn't do anything our house is on a rotating route. urgh. Like seriously. It's such bullshit

    Good! The USPS is horrible and gets away with so much shit because it's a government organization. My friend who worked at a shipping store advised all of his customers to avoid USPS because shipping through them is like putting your package in the hands of God. You have no idea what will happen to it and you'll be lucky if it makes it there.

    I had Gamefly a couple months ago. It took about a week for them to get a game back that I sent, then another week to get the game that they sent me. That was a load of crap, so I quit. When I started, it wasn't too bad, took about a week to get my new game, but also, their selection was terrible, as EVERYTHING new was marked as a "Long Wait", even 3-4 weeks after release. Screw that, I'll go rent it for $8 at Hollywood Video.

    Good! I've been using Gamefly ever since it started business, and I've loved it.

    However, I do hate Blockbuster with a passion. Every time I try to get a game there, they have a copy, but when I hand it to them, they look in the back and say, "Sorry, we can't find it, someone put this out by accident."

    I kid you not, every single time I go there, this shit happens. Over 5 times in a row, no exaggeration. Stick it to those assholes at Blockbuster, Gamefly is a much better company.

    @Kris: I figured Netflix went with the cheaper packaging since DVDs are cheaper to replace than video games and the added expense just wasn't worth it. Over maybe two years of Netflix usage, I've only had three discs arranged cracked and broken (though a few others skipped beyond cleaning). Always wondered how the discs survived that flimsy mailer so well.

    Tell me about it, I've been with Gamefly for a little over a year and I've probably had about 4 or 5 issues where my games never arrived. I'm in fear of my account being closed out as well. I've already filed a complaint with the post office myself per Gamefly's recommendation.

    I have numerous mail person's (verified from a buddy working in the post office, I guess my route is the left over route and is added to the route of numerous mail carriers).

    I always had the suspicion my games were being stolen, I figured Gamefly just assumes it's the user trying to get free games.

    I always wondered why they don't send the games in an unmarked package, but then if it is indeed the mail carriers who are stealing then I guess it wouldn't really matter. Jerks!!!

    I have experience most of those complains for the five years that I had Gamefly. I had over 8 games stolen and I knew it was the post office because I personally took them to the office. I submmitted several complains to the post master and Gamefly was really understanding of the issue. I hope this receive better treatment because in the same amount of time that I have had Netflix I only receive a broken disc once while Gamefly has had more broken disc that I can remember.

    I'm often amazed that the flimsy paper envelope my Netflix DVDs come in offers me perfectly playable discs 90% of the time.

    I did have to stop dropping them off at my apartment's mail drop though, because some ass hats were stealing all of them. Haven't had any problems now that I go directly to the post office with them.

    My friend uses GameFly. We've really liked it so far.

    We have had one game never show up, and since my friend has a community mailbox, then either a GameFly or USPS employee had to steal it (unless it somehow got lost).

    I really hope GameFly gets better treatment on this matter if possible. I want to get non-damaged games.

    Gamefly should get as good as treatment as Netflix. Gamefly is great, but I do believe USPS is holding them back. If Netflix ever decided to compete with Gamefly, Gamefly would not survive or have to shrink.

    I spend a lot of money with Gamefly especially with their cheap used and "keep it" games.

    Hm. Well I've been using Netflix for about 3 years now and just recently received my first broken disc... and I've never had a disc just NOT show up.

    But I suppose games are entirely different... pricier to buy, not to mention resale value on sites like eBay. Well good for GameFly. Hopefully this all works out for them without too much more loss.

    Nice they're finally trying to do something about it/talking to the press about it. I got my account permanently closed thanks to some jackass stealing a bunch of early PS2 Atlus games (of all the games to steal, why Wizardry?) I rented from them.

    this is great. i had gamefly for over a year, with quality eventually getting to the point that games would get lost in the mail to/from almost 50% of the time.

    apparently it was an issue in my entire area, so gamefly didn't hold me responsible for anything.

    good company, service just sucked through no fault (i'm assuming) of their own.

    seems like a legit complaint. in the year or so i've had gamefly, i havent received a broken game, and hopefully the ones ive returned have been in good condition. still, if its costing that amount of money per month, it can only be hurting the consumer in the long run.

    The blockbuster rental thing is a scam.

    I looked into before I chose Gamefly. I can't remember all the details but there was something really lame in the small print that made me choose against it.

    I think rental limits are determined by the store. Say 3 days. You can keep the game longer with no late-fees, but the game is still late. If you keep the game a week or two past it's due date, they automatically assume you bought the game, and charge you full price to purchase it.

    So although they advertise that there are no late fees, it's not what you think. YOu can't keep the game as long as you want... you do have to return it by a set date. They just wont' charge you for keeping it longer, unless you keep it long enough that they assume you bought it.

    With Gamefly, I really can keep the game as long as I want. I don't automatically purchase anything... to buy a game, I have to go out of my way to click the "Purchase" button.

    Also, with Gamefly, I get discounts on buying games after being a member for so long (3 months, 6 months, etc..). True, it's not much of a discount, but every little bit helps.

    @_Perp: Gamefly does this for me.

    I just put a game in the mail this morning. It'll get picked up tonight at 6pm and scanned into the post office computer early tomorrow morning. Because of that, Gamefly knows I no longer have the game and by mid-afternnon tomorrow I'll be able to check my Gamefly account to see which game they're sending me next.

    I think it's a post-office thing, and not a Gamefly thing.

    @lolomfgisuck: This works for me sometimes. When it doesn't there can be over a week turn around.

    Also, I have had the 3 game plan for about 6 months and have had 2 games that never made it to me and probably another 2 or 3 that never made it back.

    @McWhammer: Yeah seriously, Blockbuster has been crap for years and they're finally in danger of going out of business. I'd be worried about Netflix maybe, but not blockbuster.
