A San Jose gamer banned for his behaviour in playing Resistance wants $US55,000 from Sony and a judge to tell their mods to stop banning people.
Erik Estavillo, in a complaint filed July 6 and reported by GamePolitics today, also alleges that Sony Computer Entertainment’s comprehensive ban of him from the PlayStation Network constitutes theft, in the form of deprived access to prepaid PSN currency. The pain and suffering bit comes from Estavillo’s agoraphobia, which is fear of crowds and/or open spaces – so this is, he says, his only safe way to interact with others. And, naturally, he’s bitching about his First Amendment rights, too.
He wants $US55,000 in punitive damages and an injunction against all further banning.
It seems Estavillo’s representing himself. Yeah, couldn’t have spotted that one coming, either.

Wednesday, July 22, 2009 at 3:21 PMI tell u it’s EXTREMELY hard to get banned on PSN.
This guy must’ve really been an absolute prick, and deserves nothing, not to mention he digitally signed the EULA contract, and broke it..
Also yeah agoraphobia is so much better managed with a courtcase?!?

Thursday, July 23, 2009 at 11:50 AMsurprisingly enough it’s really not that hard to get a temp ban thrown at you. My mate has been banned a few times. The longest time was for a month. All because he was giving people a bit of shit ingame. How he acts in a game is nothing compared to me. I get extremely loud and abusive when playing. It;s just how I play. I am the same in real life. I dont take shit and i tell it how it is.
