@Zero1328: Correct, actually it's not so much part of Fair Use as it is part of ASCAP/BMI early settlements with samplists in the 80's, although there's no "standard" per se it's generally OK to use 5 seconds or less...

@Zolbrod: Yes and no. There's a law that originated in the US called "Fair Use", which should basically allow you to use a fraction of something without permission or royalty, for specific uses. Copyright laws vary by country, though, so suing should be within their rights, if they wanted to. Suing them probably won't gain much, though.

You're welcome. Also, for those wondering, this is a weekly show in which contracted singers perform. So, I'm not really sure whether SqEn will sue or send a cease and desist letter. Or just ignore it altogether.
If it was just a live performance, as it somewhat appears to be, they may get away with it, with at least a cease and desist letter asking them not to do it again. If it is the actual music video, judging by Square-Enix's stance on this sort of thing, they will likely be sued.
