Jackie Boy Gets A Visit From A Couple Of US Marshals
Posted by Luke Plunkett at 2:25 PM on June 17, 2008
Friend of Kotaku Jack Thompson was kicking back at his Florida home today when there was a knock at the door. "Whoever could it be?", he probably asked himself as he set his morning coffee down on the table. Opening the door, he was greeted by...a pair of US Marshals. Who had been sent to Jackie Boy's home by Judge Federico Moreno. Why? Oh, probably because Thompson sent a letter to Moreno last week, which ended with: "We find yesterday that enemy combatants at Guantanamo are to get more due process from federal judges than what I am to have. I guess my 'mistake' was not killing 3000 people to make my point...".
Guess the killing 3000 people thing didn't go down very well with the Judge. While Thompson stresses the Marshals were "nice gentlemen" sent only to warn him about sending those kind of letters, he's less kind to Moreno, who he accuses of trying to intimidate him by sending the pair. As such, he's going to complain to the House Judiciary Committee in Washington, accusing the Justice Department of harassing him. Oh dear.

@Clemenceau: He's not a deranged maniac, though. I love Jack Thompson-- truly I do, I may not like his habit of trying to trade on horrible events, but I love him as a person-- and he reminds me a lot of The Fonz. He's just so goofy. Like a bumbling oaf-- there's no malevolence there, just pretty friendly ineptitude. His "picture book for adults" is the kind of thing that would've made our weekly hyper multi-tap. He's like a Bond villain-- more interested in being a larger-than-life figure than in being a serious antagonist. Did you see the photo he willingly sent in to Kotaku of himself after he bought GTAIV? He looks like my goofy uncle. I love Jack Thompson completely.
So: Henry Winkler, all the way.

The thing is, he's better off losing his license. For himself and others.
He is obviously not 100% there. Look at the videos, the transcripts. Look at everything. He is is not fully sane at this point. Maybe he used to be, but not now.
He can only hurt while he remains a lawer, and I find it hard to sympathize for someone who obviously poses a threat should he remain where he is.
Besides...from the way he's acted in the past year+, he doesn't deserve sympathy. When you go out of your way to blatantly insul gamers, at a level that makes a forum troll seem sophisticated (The incident with VGCats' owner comes to mind), you don't deserve sympathy when getting bit by that behavior.

Wouldn't it be ironic if Thompson opened fire on the marshals? I could see him doing that. I also see him in 20 years becoming one of those guys that always thinks that the government is watching him, and that we live in a society where the government uses video games to control society and create the perfect soldiers. Hmmm....

Besides, there are these things on current consoles called parental controls that the parents seem to have forgotton about, and honestly, its not up to the lawyers or the government to parent children, its up to the parents, the ones that should be parenting their children.

@Ashkihyena: ESRB begs to differ. I guess I wasn't clear, so I'll specify: Some lawyers are against video game CONTENT, and make sense of what they are against. It's important to note that putting limits on games don't necessary make them lose their charm, may it be by making the game rating go up (from E to RP) or simply by removing stuff that just go too far.
Not all anti video-game lawyers are out to get video gamers. Most do it for the kids whom the parents want to protect. Thinking that lawyers only defend against some video game content because they don't "do anything except for people who have mental problems and the sort" is a crappy argument, childish at best.

@FeatherNET: Yeah, the only problem there though tends to be when kids can't get ahold of games, adults can't either.
Granted, some of the time it doesn't happen, but a majority of the time, if someone doesn't want sold to kids, they don't want it sold to anyone.
Take San Andreas for example, when the Hot Coffee thing was exposed, Hillary Clinton freaked out and went "what about the children?!" even when it was an M rated game to begin with.

@Ashkihyena: I understand what you're getting at, but real lawyers (not freelance crusaders like Jackie Boy) are hired, not on their own secret agenda.
I do agree, developpers do have their own liberties, porn included. The point of being against video games is not necessarily to shut them up, but to limit who they reach. Parenting plays a great role (when played, mind you), but they also hire lawyers to protect other kids.
Going against what medias seem to push people to think, not all lawyers are evil people who want to make the video game industry die an unsettling death. Some of them do, and those are the ones talked about. Alot of them don't. But then that's not interesting news, now is it.
Going back to my original point, Johnny boy here is nothing like a lawyer, hell he's more an actor / comedian than what his bloody badge tells us. For gods sake, he's expecting to go after a judge because two guys doing their job knocked at his door in the morning and told him to cool down.

He ran against Janet Reno in a public election in the early nineties, called her a lesbian, and pressed charges against her for assault. He was also the one who led the charge against 2 Live Crew that wound up with them being dropped from many stores for being obscene. He really believes in what he does, and feels it's his religious obligation to defend us from abhorrent material as he defines it-- he just happens to be awfully inept. But he isn't in it for some dubious fame. Do a bit of research.

I took a moment to wonder exactly why Thompson lasted this long if he was such a reactionary lawyer -- why he hadn't gotten himself disbarred or jailed years ago.
I know exactly why. Fame.
Thompson was a run-of-the-mill attorney; a face in the crowd. He was one of countless lawyers in the country, taking cases and paying the bills. One day he discovered that going after the Grand Theft Auto series -- an emerging fad in the news media -- got you famous. The more he complained, the more people paid him for interviews and television testimony. That was great, until he went too far. He crossed enough lines that corporations -- who, until then, were content to let Jack's voice join the media chorus -- got their own legal teams to address the issue. Bulletproof Jack thought he could just bluster his way through it, and he was wrong. Now he can't even file cases in his home state.
Now he's just doing it for the attention. He's no longer getting paid for the stunts he pulls -- in fact, those stunts have killed his career. He's a laughingstock, and the news programs that had him on as recently as two months ago for some quality sound bites about the Evils Of GTA IV wouldn't let him on their shows now to talk about the same subject if HE paid THEM.
He's gone from being an ethically bankrupt celebrity to a cranky old has-been. There are hundreds of those in Florida. Jack only stands out because he can still get his name in the papers.
Guess it keeps him from being a face in the crowd.

@Ashkihyena: That's a sad fact. But then, perhaps (and I have no proof whatsoever of this, less I go review cases for the sheer hell of it) there were people against the game being sold to minors before the mod.
My opinion on this is simple. Going against video games because of the mainstream media is one thing. Going against it because of family values is another. Some lawyers are actually nice people who like to play Halo and stuff, but defend clients because that's their jobs. Other lawyers go offtrack and simply act on moral outrage and misguided values to try and destroy everything that doesn't fit in their own narrow point of view.
Those are the people who make the good people look like jerks.
@Tora: I don't know. Maybe so. But then, if it didn't happen, some situations (not involving video games) would go unresolved. I mean, a parent shouldn't assault their childs, the law says so. Take that away, and some parents might just go ahead and do just that. It's stupid, but some people need excuses not to do stupid things.

@CaptLtrl: Me too... So easy to picture him freaking out in the middle of a traffic jam and just going completely postal.
On a more serious note, when people under stress start to issue complaints like "my mistake was not killing 3000 people..." then you seriously have to start looking at him as a possible risk - hence the Marshall visit.
The Judge could never let him send that letter and not be seen to respond to it in some manner that goes towards preventing an 'incident' or negating its later fallout upon the Judge (for not responding/doing anything to interupt the flow of rage).
i.e. If the dude does go postal, he/she can say "Hey look, I sent some Marshalls around there, what else should I have done...?"

How very hyppocritical. Isn't Jackie boy the one who tried to get the FBI sent over to the boys at Penny Arcade in order to strong arm them. Now he takes offense over a similar act (although this one was justified.) I guess in Jack's mind justice should only work one way, his way.

Your analogy is flawed. The laws prohibiting assault on a child are laws ensuring a right. They are protecting the rights of the child to be free from physical harm.
Any laws prohibiting the content of video games remove rights, namely the free speech of the developer and the right of the consumer to choose what is within his moral boundaries for himself. I am -not- harming others by playing a video game, so why should the government limit my choice of product? How far is the "too far" you mentioned. Is this one of those "I'll know it when I see it" arguments?
It is perfectly within the rights of companies to not allow games to be released on their platform. It is within the rights of parents to limit the games their kids play. It is withing the rights of stores to limit what games they choose to sell. Hell, I'm even okay with laws preventing the sale of M rated games to minors (akin to laws preventing the sale of R rated movies to minors). What I'm -not- okay with is the removal or prohibition of content produced by and purchased by consenting developers and consumers, respectively. Even if it's "for the children."
Also, don't attempt to displace ire against lawyers by saying "they're just doing their job for overzealous citizens." Correct me if I'm wrong, but unless they're a court appointed attorney, they have the right to refuse to be council for such ridiculous cases. If the choose to represent such people, they bear the responsibility of being associated with that decision.
