Jack Thompson Disbarred

Is it finally game over for Florida lawyer and violent video game opponent Jack Thompson? Judgment has been entered in the case that started last year and came to a head when Judge Dava Tunis recommended permanent disbarment for the bombastic, showboating law man. The court has approved the report and has ordered that JT is officially disbarred as of 30 days from today.
The Court approves the corrected referee's report and John Bruce Thompson is permanently disbarred, effective thirty days from the date of this order so that respondent can close out his practice and protect the interests of existing clients. If respondent notifies the Court in writing that he is no longer practicing and does not need the thirty days to protect existing clients, this Court will enter an order making the permanent disbarment effective immediately. Respondent shall accept no new business from the date this order is filed.
Note that Thompson still has a chance for a retrial, only due to court sanctions the motion must me submitted by a member of the Florida Bar in good standing, and I don't know that anyone wants to touch this one. It's also worth noting that along with disbarment, Thompson has been ordered to reimburse the Florida Bar fees amounting to $43,675.35. Ouch.
We've contacted both the Supreme Court of Florida and Jack Thompson for comment and will update the story if both or either respond.

The referee has filed a corrected report recommending that respondent, John Bruce Thompson, be permanently disbarred without leave to apply for readmission to The Florida Bar. Respondent submitted a petition for review of the referee's report. The Clerk did not accept the petition for review for filing. This action was in accord with this Court's opinion dated March 20, 2008, which sanctioned respondent for abusive filings and barred him from filing on his own behalf. The sanction opinion provided, in pertinent part: "the Clerk of this Court is hereby instructed to reject for filing any future pleadings, petitions, motions, documents, or other filings submitted by John Bruce Thompson, unless signed by a member in good standing of The Florida Bar other than himself." Fla. Bar v. Thompson, 979 So. 2d 917, 921 (Fla. 2008). The opinion also noted: "in sanctioning respondent, we are requiring him to retain qualified counsel so that his arguments might be properly presented through the appropriate procedures in the appropriate forum. We do not limit such counsel's ability to challenge the referee's findings and recommendations on review." Id. at 919.
Ignoring this bar on self-submitted filings, respondent has submitted numerous filings in violation of the sanction opinion, including the petition for review of the referee's report. The Clerk properly rejected each of these submissions. Thus, there being no authorised petition for review filed, and the time period to seek review has passed, the Court has treated this as an uncontested case. The Court has reviewed the 169-page corrected report of the referee filed on July 16, 2008, for sufficiency and has determined that permanent disbarment is merited on this record. (This report is posted on the Court's public website). The report Case Nos. SC07-80 and SC07-354
Page Two details the extensive misconduct of respondent and his complete lack of remorse. In her report, the referee states: Over a very extended period of time involving a number of totally unrelated cases and individuals, [r]espondent has demonstrated a pattern of conduct to strike out harshly, extensively, repeatedly and willfully to simply try to bring as much difficulty, distraction and anguish to those he considers in opposition to his causes. He does not proceed within the guidelines of appropriate professional behaviour, but rather uses other means available to intimidate, harass, or bring public disrepute to those whom he perceives oppose him.
Among the extensive findings of fact presented in the report, the Court takes particular note of the following which occurred during the three-year period at issue in five counts in these cases: (1) respondent made false statements of material fact to courts and repeatedly violated a court order; (2) respondent communicated the subject of representation directly with clients of opposing counsel; (3) respondent engaged in prohibited ex parte communications; (4) respondent publicized and sent hundreds of pages of vitriolic and disparaging missives, letters, faxes, and press releases, to the affected individuals; (5) respondent targeted an individual who was not involved with respondent in any way, merely due to "the position [the individual] holds in state and national politics;" (6) respondent falsely, recklessly, and publicly accused a judge as being amenable to the "fixing" of cases; (7) respondent sent courts inappropriate and offensive sexual materials; (8) respondent falsely and publicly accused various attorneys and their clients of engaging in a conspiracy/enterprise involving "the criminal distribution of sexual materials to minors" and attempted to get prosecuting authorities to charge these attorneys and their clients for racketeering and extortion; (9) respondent harassed the former client of an attorney in an effort to get the client to use its influence to persuade the attorney to withdraw a defamation suit filed by the attorney against respondent; and (10) respondent retaliated against attorneys who filed Bar complaints against him for his unethical conduct by asserting to their clients, government officials, politicians, the media, female lawyers in their law firm, employees, personal friends, acquaintances, and their wives, that the attorneys were criminal Case Nos. SC07-80 and SC07-354 Page Three pornographers who objectify women.
The Court concludes that the facts, as even more extensively detailed in the referee's report, support the referee's numerous recommendations as to guilt. The referee cited various cases indicating that disbarment is an appropriate sanction and recommended permanent disbarment because "[r]espondent has repeatedly stated in these proceedings that he will not change his conduct" and she "finds no evidence whatsoever to indicate that [r]espondent is amenable to rehabilitation, or even remotely appreciates the basis upon which a need or purpose for such rehabilitation is warranted." Indeed, as noted by the referee: Respondent has repeatedly failed to follow the appropriate rules and orders throughout these disciplinary proceedings as evidenced by the granting of the Bar's Motion for Sanctions and the Supreme Court of Florida's orders of February 19, 2008 and March 20, 2008, wherein the Court found that [r]espondent "abused the legal system by submitting numerous, frivolous and inappropriate filings," despite being warned not to do so. In fact, the referee reported that respondent walked out of her courtroom at the final hearing in this matter because she would not allow him to "to turn the [d]isciplinary proceeding into a press conference." Based on the record before it, the Court agrees that respondent is not amenable to rehabilitation. Further, the Court approves the referee's recommendation that permanent disbarment is the appropriate sanction.

Err.. the guy walked all over court procedures. He was a total ass in court (according to transcripts). He faxed people porn as "evidence." He lied, harassed and disrupted the lives of ordinary people and professionals. He used his family for leverage and tried to hamhandedly manipulate proceedings. He probably never hit anyone, Swift_, but what's done is done.
Nobody should feel bad for him. He actively destroyed his own career through misconduct and tactless behavior.

Remember, just because he isn't a lawyer doesn't mean he can't do almost all of the same crap as before. The only difference is that when he wants to take legal action it must be a little less crazy than before in order to ensure that another lawyer won't risk sanctions for filing it.
This really doesn't change much at all, I'm sad to say.

The problem here is that he wasn't just advocating what he believes in. It's not just that he was outright lying and making things up to get his point across. The issue in question is his overall professional attitude. You just don't go around telling Judges to their face that they are idiots in the middle of the courtroom. This is a guys who is consistant been in contempt of court. Not a good quality for a lawyer to have.

The disbarment was for Florida. I'm not sure if he's licensed in any other states.
Advocating what he believes in had nothing to do with this decision. It was the reckless and sometimes unlawful manner with which he conducted himself.
It was his contempt for the Florida State Supreme Court.
Honestly, if you have ever read anything written by him, you'd support this fully. We don't allow angry 13 year olds with a tenuous grasp of the English language to be lawyers, and we shouldn't allow adults who behave like them to be lawyers either.

@Swift_: No one was barring him from speaking. Even if they did, the only right he has is to be protected from the government censoring him. Not anyone else. He was disbarred for conduct. He didn't follow the rules of his own profession that he agreed to once he became a lawyer. Not to be snarky or anything but have you been following this at all?

The man abused his power as a lawyer to call for police surveillance on people that simply disagreed with him. That in itself deserves disbarment for some time. I'm not sure how he was allowed to be a lawyer for so long, all the cases he pursued, he did so with no tact and with a slant of God-fear induced rage. People like that deserve to be on some "American" political talk show, not the courtroom.

The problem is he hasn't been working towards a career and now he's being punished for beliefs he has exterior to it. He's been actively miss-using powers leveled to him because of said career. If he strongly believed video games were bad but he pursued through the courts in a lproper manner this wouldn't have happened.

I rather think Jack had a right to speak out as much as he liked. He wasn't hitting people or anything. Having him out there sparked a lot of discussion, and some of it was rather intelligent. We might not have agreed with his ultimate objective, but he got the community postulating and morality to lesser degrees of severity.
Today represents a troubling day for censorship of speech and ideas. Better was that he continued doing what he was doing, and we were free to listen or not listen to him.
That said, he did sue a lot for unfounded reasons. That was a bit much.

Unfortunately, I don't think we've seen the last of this lunatic, or even the worst of him. If he can't pursue his delusions in court, he'll become a lobbyist and pursue them in Congress: a place where he already has far too many allies.

Its a good thing to see someone so misguided no longer a threat, but I do feel bad for the guy a bit myself. He may have been oh oh oh oh so wrong on oh so many things, but he did do what he thought in his own way was write. He got drunk on his own imaginary power, so I guess the moral to the story is that even in America if you do incredibly dumb stuff and cost the courts lots of money over the course of several years, you will get your come-up-ins.

Nothing changes.
If you think this will stop the man from putting himself in the spotlight (Even Fox stopped referring to him as an 'attorney' and started referring to him as a 'First Amendment Expert' recently) then you're naive. EXTREMELY naive.
I'm glad he got what was coming to him, but this will likely just further fuel his particular brand of zealotry. Now he's a martyr for his own cause.
So celebrate, but don't think for a second that this will somehow REMOVE JT as a thorn in the video game community's side.

The larger the industry gets, the less resistance we will feel. The harness loosens as gaming becomes more socially acceptable.

@Archaotic: Each state has it's own bar. If he only ever applied for the license to practice law in FL, that's the only state he'd be legally entitled to practice law in.
If you've ever seen TV commercials for 'You could collect money damages'-type class-action lawsuits, the fine print at the end always lists only the states in which the participating law firms have licenses. Any legal proceedings will have to take place in one of those states.

Eh. I kinda feel bad for him. After reading the list of stuff he did to bring this about I can't say he didn't deserve it; but still... it's called human compassion.

@Brian Crecente: That may be true, but I think he's approaching this whole video game violence thing the wrong way. Instead of making video games evil, why isn't he examining the possibility that people aren't making the right choices based off of how they interact with video games? I think it's definitely the person who shoots up the school who is at fault for murder, not some media influence they may or may not have had. You are only as affected by the media as you choose to be. No one is twisting your arm to make you play the newest Doom or Grand Theft Auto.
That being said, I am actually kind of glad that he got disbarred, maybe it will make him rethink his approach. I understand what he is doing and why he is doing it, but I think he may be going a little overboard.

Poor Mr. Thompson, he was a misguided man but his actions were certainly nothing to leave him in ruin for. I wonder, did any lawyers have their licenses revoked for fighting against TV, Rock % Roll music or comic books? Videogames are just the most recently developed form of entertainment that some people don't understand and therefore fear. Mr. Thompson goes on crazy rampages and writes in his legal briefs - filed with actual courts of law - as would a 10 year old. I just happen to mention, for the first time, that I'm a lawyer due to the relevance of this louse losing his law license. Or, am I missing something here?

Well at least we can hope that this vulture of an excuse for a human being will no longer be an "expert" now that this has been taken into effect, especially since it's a permanent disbarrment. Seeing this asshole appear on the news after every shooting, murder and accident to throw the blame was an affront to the people lost and the folks left behind.

May his case serve as a lesson for other attourneys and professionals thinking of abusing their powers to their own selfish reasons and distort people beliefs.
This isn't about saying video games are bad, this is about mis-usage of privileges his career gave him.

I can see it, if you take it for WAY more then what it is trying to be(and yet less...). The fun parts of the worst offenders are, generally, the murderous ones.
I like GTA4 because, while it may highlight this fact, the criminals are not glorified, themselves. Dwayne, for instance, went to jail for his crimes. Now look at him. He's broken and miserable. Basically every criminal in that game is a miserable, angry person.
Look at it for what it is and what message do you get? Don't be like these people.
If only people like Jack saw it this way.
It really is too bad shitty parents let their stupid kids play stuff like this without highlighting the real message. Games do effect people psychologically. They can't not, if they're good at what they are trying to accomplish.
Education and critical thinking is key. Censorship just pisses people off and makes, many of them, more angry.
