Thompson Responds To Disbarment

Today's stunning news that controversial attorney and anti-gaming zealot Jack Thompson will be disbarred for life from practicing law by the Supreme Court of Florida seems to have done little to faze the attorney himself.
In response to our request for comment Thompson sent Kotaku a copy of an emergency motion he filed with the court, this despite the ruling which states that only another attorney in good standing with the Florida Bar could file a motion for rehearing on Thompson's behalf.
In the motion Thompson outlines what he hints at as a perversion of justice, one that won't allow him, for instance, to meet with a potential client who he says is an inmate in a state prison.
Thompson also sent over a press release saying that the disbarment is in retaliation for, among other things, Thompson's Tyndale House book Out of Harm's Way which he says blew the whistle on what he describes as the Florida Supreme Court's attack on his activism against the American entertainment industry.
The timing of this disbarment transparently reveals its motivation: This past Friday Thompson filed a federal civil rights action against The Bar, the Supreme Court, and all seven of its Justices. This rush to disbarment is in retribution for the filing of that federal suit. With enemies this foolish, Thompson needs only the loyal friends he has.

Miami Attorney Jack Thompson Disbarred by Florida Supreme Court
Miami attorney Jack Thompson, nationally and internationally known by virtue of his effective and successful opposition over the last 20 years to the broadcast, marketing, and sale of adult-rated entertainment to children, has just been informed by the Florida Supreme Court that he has been disbarred from the practice of law today.
This disbarment is in retaliation, among other things, for Thompson's Tyndale House book Out of Harm's Way, published in 2005, which blew the whistle on the Florida Supreme Court's earlier efforts in the 1990's to literally pathologize his faith-based and successful activism against the American entertainment industry. The Florida Bar's insurance carrier was forced to pay Thompson money damages for that earlier assault upon his First Amendment rights, which is the only known payment of damages by any state bar to any lawyer for improper disciplinary efforts. It appears that the State of Florida will be paying Thompson more damages this time around for its illegal, now repeated, use of "discipline" to punish a Christian lawyer for his activism in the public square.
The timing of this disbarment transparently reveals its motivation: This past Friday Thompson filed a federal civil rights action against The Bar, the Supreme Court, and all seven of its Justices. PLAINTIFF'S EMERGENCY MOTION TO STAY FLORIDA SUPREME COURT'S PERMANENT DISBARMENT ORDER OF SEPTEMBER 25, 2008
COMES NOW PLAINTIFF, on his own behalf, and moves this federal court, pursuant to the applicable Federal Rules of Civil Procedure, for the following emergency relief on the following grounds, stating:
1. All seventy-seven defendants have been served with the complaint herein; thus, they are all fully on notice as to the nature of this suit, the relief sought, and the basis therefor.
2. Today, at approximately 11 am, on September 25, 2008, the Florida Supreme Court, has entered an order, a copy of which is attached hereto, permanently disbarring plaintiff Thompson, the respondent therein, effective in thirty days. Thus, the clock is now running on those thirty days. This is an emergency.
3. Under this order, Thompson is unable, for example, to meet, as he is scheduled to do next Friday, with Richard Gorman, who is an inmate in a state prison for the purpose of being retained by him as his lawyer. Mr. Gorman is sitting in his prison cell solely because of the unethical conduct of Assistant State Attorney Matthew Alex Smith and the obstruction of justice by the Board of Governors of The Florida Bar. The attached Report of No Probable Cause is a smoking gun document that proves that the entire Board of Governors of The Florida Bar is involved in a cover-up in order to keep this innocent man in jail, all for the purpose of protecting the corrupt Leon County State Attorney's Office. It is the single most remarkable document Thompson has ever seen in his 31-year legal career. It indicts the entire Bar's disciplinary process which in that instance is being perverted to keep an innocent man in jail. It is little wonder that these same Governors would then do to Thompson what they have demonstrably done over the past four years.
4. Thompson was to meet with Mr. Gorman for the purpose of securing his release from jail, and now Thompson cannot be retained by Mr. Gorman for that or for any other purpose. Thus, one of the consequences of this disbarment order is not only Thompson's inconvenience, to say the least, but more importantly the thwarting of the retention of Thompson by an innocent man in jail who is the victim of the obstruction of justice of The Florida Bar and its Governors.
5. Plaintiff herein thus seeks an immediate stay, on an emergency basis, of the Florida Supreme Court's disbarment order because he can show a substantial likelihood of success on the merits, irreparable harm unless the injunction issues, including public damage to his career and to the rights of others, such as those of Mr. Gorman, that this harm far outweighs any conceivable harm to defendants if the injunction issues, and that the injunction will not disserve but actually serve the public interest.
6. Further, there are demonstrable factual errors in the disbarment order itself, which provide the basis for the disbarment, which can be easily and quickly proven. Additionally, it is fascinating that Justice Cannady, who has undoubtedly reviewed absolutely nothing about this disciplinary case, has put his name to this disbarment order on the day that he was served with the federal civil rights action. What a coincidence.
WHEREFORE, plaintiff respectfully seeks an order, on an emergency basis, staying the Florida Supreme Court's disbarment order until such time as an evidentiary hearing, either before Judge Cooke or Magistrate Bandstra, can be secured as to the granting of apreliminary injunction sought in the complaint.
I HEREBY CERTIFY that this pleading has been provided to all defendants and/or their counsel by various means, including fax and e-mail, this September 25, 2008.

Hey Gents — I spoke to Jack T. about 2 months ago. I am Rich Gorman’s Dad. I suck at video games and gave up after Space Invaders. I am a retired executive. You are missing a HUGE Humanatarian constitutional connection. Jack has always claimed ” corrupt” and “foul” about the Fla. BAR. WELL — I can PROVE IT !! My son was railroaded in Tallahassse on a (BS BS BS) 10 second date rape! When the prosecutor knew he was losing - he conjured up a second charge for leverage. The scum bag ended up prosecuting Richie 2 times with NO Probable Cause. That means he had NO reason to continue. He did and he cheated and he lied, etc misconduct — he also committed a felony against richie !! I filed a BAR complaint against the prosecutor AND the Grievance Committee found him guilty of illegally prosecuting - after a 9 month investigation. The only NIFONG -like prosecutor found in Fla in 10 years. So, instead of my son getting help, the Board of Governors “dismissed” the charges against Matt Smith Prosecutor , and wrote me a letter — Smith is guilty, we agree with the investigators, too bad Mr. Gorman - we have to protect our own asses. (essenceof ltr). So like Jack or Hate Jack, Jack has found 100% proof that the Fla. BAR is a bunch of criminals. The Fla BAR a -holes just called my sons prison and said DO NOT let Jack see Richie on Friday !! Sounds like a scared bunch of pusses to me. My son was a video king before he was falsely prosecuted. The sympathy people are expressing here is truly moronic. It is incredibly difficult to get someone disbarred, the legal system likes to protect it's own, even when they go bat-shit crazy like Thompson.
So when you do read that someone has been disbarred for something less than a violent crime, believe me, they had it coming a long time before it ever reached the point of losing there job.
Besides, his book sales will spike over the next few days, wait and see.

I'm really beginning to think he may have more serious mental health problems, along the line of acute paranoia and delusions of grandeur:

Honestly, I haven't cared about this guy for quite some time and was enjoying not seeing him in the spotlight. He's a hack lawyer trying to make an easy buck and thrives on being talked about. I really wish sites like this would quit giving him the attention he craves and start ignoring him altogether. Maybe then will he realize just how unimportant he and his "crusades" are and do everyone a favor and do something more productive with his time.
I know that will never happen, but hey a guy can dream right?

While my distaste for Mr. Thompson knows no bounds, it does seem a bit much for an immediate disbarment. But then, I also don't know the full facts of the case.

This is something I've pointed out before about Thomson's "professionalism".
"Thompson always wanted to own a Bar. Now, armed with multiple US Supreme Court rulings that no state bar can do what it has done to Thompson, he is set to own that Bar."
Does that sound like a professional lawyer defending his point? Or does it read more like a guy on a forum trying to sound clever?
You see it in numerous press releases, and even in court documents. While this type of bravado and snark may produce an excellent soundbyte for CNN or Fox, it has absolutely no place in a legal environment.
Especially not when you've just been disbarred for this very type of behavior.

Here is a document that Jack Thompson should be famliar with, but isn't:
It's the Bill of Rights from the United States Constitution. He should take a very close look at the First Amendment, especially this part:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
So Jack continue your unconstitutonal crusades, but I take comfort that every one of your efforts to get things banned will get thrown out like two week old Chinese take-out.

I also think Thomson has an email group (Kotaku included) that he routinely sends press releases to.
He also would've known about this before any of us. And knowing Thomson's style (really any good lawyer should do this), he'd have this plan ready to go if it didn't go his way.
If they tell the client or not, every lawyer has a backup plan. That's what they're paid to do.

Probably happiest of all is Janet Reno. I'd like to see what she has to say about this, considering she was personally attacked by Thompson multiple times on the public stage. And I'm not talking Bill O'Reilly "thinly veiled sarcasm" attack either, I'm talking about blunt claims of homosexuality and a lawsuit of "assault" for being touched on the shoulder by Reno. I do think that he is, after this AND when he filed for the 20 something motions after the motion for his disbarment was announced that was supposed to keep him from doing ANY lawyering, totally completely bonkers. Insane. Nuts. Kooky. Just plain crazy. "What's that? I'm not supposed to do any of this? Well I'll do it anyways! What? I can't ever do any of this again? Well I'll just keep on keeping on doing it!"
I mean...my god, does the man not know when to quit? Does he REALLY think that there is a conspiracy against him? Don't know if this question was already answered, but I am a lawyer in NC and while technically he could just apply to another states Bar, but unless he has a political connection, it would be hard for him to get accepted by another Bar. Especially after the type of permanent disbarment he has gone through.
I wouldnt cry for him though, I could easily see him getting a Professorship at some Christian/Neo-Con place of higher learning in no time.

A couple of things....
1. As a member in good standing of the Florida Bar, let me say good riddance. Even if you completely ignore everything he ever did or said about video games he's still an embarrassment to the profession.
2. He's not going to any other state. State Bars, as a matter of practice, respect the suspensions and disbarments of the other bars. So by being disbarred in Florida he's not really going to be able to pick things up and go to another state.

As I'd said in the lead-up to this, I pity the guy because I don't think he's trying to defraud or abuse the system - I think he really believes he's doing right.
But given his history of wildly inappropriate conduct even for a defendant, much less a supposed lawyer, I think he's really given them no choice but to disbar him. As a lawyer he could do some serious damage if allowed to continue practicing such incompetence.

Also, will Jack ever quit speaking in the third person? Who wants to place a bet? I don't know what odds to give, but I'd say they're fairly high on it never happening.

So... according to this filing, Jack is basically up against the world here. Sounds like good odds... for everyone else.

This article fails it with "only another attorney in good standing with the Florida Bar could file a motion for rehearing on Thompson's behalf." Thompson is still allowed to represent himself, as any person is able to do so in the courts of the land.

actually he might not be able to practice law in any US state after this. part of being admitted to the bar is a background check, and they evaluate your moral character based on past misdeeds. something like minor assault (from a bar fight or whatever) or even unpaid parking tickets can keep you from being admitted. being **disbarred** in another state would definitely count against you in a major way.
