			<content:encoded><![CDATA[<p><img src="http://cache.gawker.com/assets/images/kotaku/2009/05/objectds3.jpg" alt="" class="left" />In 2007, Sony <a href="http://kotaku.com/240889/sony-settles-with-immersion-will-rumble-return">settled a long-running dispute with Immersion</a>, a company holding patents for control pad rumble technology. The world moved on. But now, the lawsuit (or at least part of it) is <em>back</em>.<span id="more-337840"></span></p>
<p>A guy by the name of Craig Thorner, an engineer who held a few patents related to rumble tech, was a witness in the case, who helped Sony in their attempts to &#8221; invalidate Immersion&#8217;s patents&#8221;.</p>
<p>Now, two years later, Thorner is suing Sony.</p>
<p>He claims that, shortly after the original Sony/Immersion suit was filed, a company by the name of Performance Designed Products LLC got in touch with him, claiming that, like Sony, they&#8217;d been targeted by Immersion&#8217;s lawyers. PDP asked for his help.</p>
<p>In the process of providing that help, Thorner says he licensed some of his own patents to PDP, and in doing so enlisted the help of some lawyers. The same lawyers who, it turns out, were in the process of handling Sony&#8217;s case against Immersion. Those lawyers, Thorner alleges, &#8220;encouraged him to accept terms that were less than favorable&#8221;.</p>
<p>Those terms included a big reduction in the amount of royalty fees he was asking for, along with a provision that would allow not just PDP &#8211; but, importantly, Sony as well &#8211; to licence his patents.</p>
<p>Thorner is now accusing Sony and PDP of working together, scheming to acquire his patents on the cheap, and is suing the pair of them for legal malpractice, as well as suing Sony for patent infringement.</p>

<p>Maybe Sony Computer Entertainment America are thinking of releasing the silver PS3 &#8211; currently only available in Asia &#8211; in the US. Maybe they just feel like tarting up the currently drab lineup of DS3 pads. Either way, GameStop say the pads will be out towards the end of June, and they&#8217;re going for the standard price of US$55.</p>
<p>Shame it&#8217;s the silver pad and not <a href="http://kotaku.com/329497/oh-good-my-dualshock-3s-arrived">the classier white one</a>.</p>

<p>Takahashi showed off an early prototype of the title, way before it was bound for release via the PlayStation Network. While crude, it showed off many of <em>Noby Noby Boy</em>&#8217;s gameplay mechanics. But there was a problem, forcing the game to change platforms.</p>
<p>Takahashi says that, because the Xbox 360 was selling so slowly in Japan at the time, you might think that it was a political decision. But the switch from the Xbox 360 to PS3 was due to one thing: the horizontal layout of the PlayStation 3&#8217;s DualShock/Sixaxis.</p>
<p>The Xbox 360 controller&#8217;s diagonal analogue stick layout was simply no good.</p>
<p>Besides, Takahashi says that one of his hopes for <em>Noby Noby Boy</em> was that it wouldn&#8217;t sell very well. More on that later.</p>

<p>To be released on March 12 for ¥8980 (USD$95), the little box will include a copy of Resistance 2 along with a DualShock 3. While the box pictured has a white controller, Sony say the pack will also come in black and silver as well.</p>
<p>We&#8217;d recommend the white one, <a href="http://kotaku.com/329497/oh-good-my-dualshock-3s-arrived">as we do in all DualShock 3-related matters</a>. Its matte finish just feels <em>better</em>.</p>
